DMCA COPYRIGHT POLICY

1. OVERVIEW

Xotic Tech OU (operating as Xotic AI, xotic.ai) respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512), we will respond promptly to claims of copyright infringement committed using our services.

If you believe that content available on or through xotic.ai infringes one or more of your copyrights, please notify our designated copyright agent using the information below.

2. DESIGNATED COPYRIGHT AGENT

All DMCA notices must be sent to our designated agent. Notices sent to any other address will not be accepted as valid DMCA takedown requests.

3. HOW TO SUBMIT A TAKEDOWN NOTICE

To be effective under 17 U.S.C. §512(c)(3), your written notification must include all of the following:

1. A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g. the URL of the specific page).
4. Information reasonably sufficient to permit us to contact you — including your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. COUNTER-NOTIFICATION PROCESS

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated agent at [email protected].

A valid counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that has been removed or disabled and the location at which it appeared before removal or disabling.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Xotic Tech OU may be found), and that you will accept service of process from the person who provided the original notification.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If we do not receive notice within 10–14 business days that the complainant has filed a court action, we may restore the removed material at our discretion.

5. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable law, Xotic AI has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Xotic AI may also, at its sole discretion, limit access to or terminate the accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. SCOPE & LIMITATIONS

Xotic AI is an AI-generated content platform. All characters, images, and generated media are synthetic and do not depict real individuals. If you believe AI-generated content on our platform reproduces or is substantially similar to a specific copyrighted work you own, please include as much detail as possible about the original work and the specific infringing output in your notice.

Nothing in this policy limits any legal rights Xotic Tech OU may have under applicable law, including the right to remove content for reasons other than copyright infringement.
